MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING: DENIED <br /> Janet E. and Barry Krock, Trustees <br /> 4 Cross Street <br /> Mashpee, MA 02649 <br /> Finding-2012-42 <br /> non-conforming structure or use to the neighborhood and that there is adequate land area <br /> to provide sufficient parking and setbacks as may be required. <br /> After public hearing on this matter, and in consideration of the above-noted <br /> findings, the Board has determined that the substantially increased size and lot coverage <br /> of the proposed dwelling is inconsistent with the underlying purpose and intent of the By- <br /> laws to limit the density and lot coverage of structures in residential districts, will create <br /> negative visual impacts to abutters and neighborhood residents accessing the beach to the <br /> rear of the locus, could impair and/or undermine the stability of the coastal bank to the <br /> rear of the locus, and pose public safety hazards with respect to the abutting parcel of <br /> land currently owned by the Petitioners (but potentially developable or usable by others <br /> in the future). In addition, the increased size and lot coverage of the proposed dwelling <br /> would negatively impact existing drainage issues on the property and at neighboring <br /> properties by significantly decreasing the permeable surface and increasing the water <br /> flow in and around the locus. Finally, the proposed structure encroaches on the coastal <br /> bank and existing pedestrian pathways, in violation of the Mashpee By-laws §174-33, <br /> causing an adverse impact on the nearby waterways. For the respective reasons set forth . <br /> herein, the Board finds that the development of this project would be substantially more <br /> detrimental to the neighborhood than the existing dwelling, and does not provide <br /> sufficient setbacks and open lot space as required under the By-laws. Accordingly, the <br /> Board finds that the Petitioner has not meet the standards set forth in the Mashpee By- <br /> laws §174-17; therefore, the Board votes unanimously to DENY the Petitioners' Petition <br /> for a Written Finding. <br /> 5 <br />
