Chapter 40A Section 6 and <br /> Section 174-17 of the Zoning By-laws regarding continuance, extensions or alterations to <br /> allow for construction of additions to a non-conforming, single-family dwelling structure <br /> on property located in an R-5 zoning district at 46 Meadow Haven Drive (Map 47 Parcel <br /> 46)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 21, and <br /> September 28, 2012, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on October <br /> 10, 2012. The following members of the Board were present and acting throughout: <br /> Board Members Jonathan D. Furbush, William A. Blaisdell, Ronald S. Bonvie, James <br /> Reiffarth, and Judith M. Horton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Robert Blackburn, Jr. represented his Petition and stated that he and his wife <br /> would like to expand the living space of their dwelling to accommodate their growing <br /> family. Plans call for construction of an 8x14-foot addition to the garage with two <br /> finished bedrooms above the garage. He submitted diagrams of the proposal, which will <br /> not encroach any further into the sideline setback of the abutting property. The closest <br /> corner of the existing garage to the side setback is currently 23 feet. Proposed lot <br /> coverage will be 10.7% of the 18,000 square-foot parcel. <br /> Due to the presence of an abandoned bog behind the subject property, <br /> Conservation Agent Andrew McManus has scheduled a site visit on Friday, October 12, <br /> 2012 to determine if the proposal is within Conservation jurisdiction. <br /> The Board of Health requires a septic inspection prior to issuance of a building <br /> permit. <br />
