Power <br /> requesting a Written Finding under M.G.L. Chapter 40A §6 and §174-17 of the Zoning <br /> By-laws to allow for construction of a single-family dwelling on property located in an <br /> R-3 zoning district within the Popponesset Overlay District at 6 Deans Hollow Road <br /> (Map 117 Parcel 72)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 5, and October 12, <br /> 2012, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on October <br /> 24, 2012. The following members of the Board were present and acting throughout: <br /> Board Members Jonathan D. Furbush, William A. Blaisdell, Ronald S. Bonvie, James <br /> Reiffarth, and Judith M. Horton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Attorney Kevin M. Kirrane and John Slavinsky from Cape & Islands Engineering <br /> represented the Petitions. Architect Timothy Luff also attended the meeting. Attorney <br /> Kirrane submitted photos of the dwelling which was constructed in the 1950's. Assessed <br /> value of the subject parcel of land is over$600,000, while the dwelling is only assessed at <br /> $45,000. The existing non-conforming structure does not conform to the sideline setback <br /> requirements. Plans call for demolition of the existing structure to be replaced with <br /> construction of a new dwelling that conforms to the side setback requirements. The new <br /> dwelling will also conform to the height requirements of the Popponesset Overlay <br /> District. Attorney Kirrane said that the proposal will add substantial value to the property <br /> and will be an enhancement to the neighborhood. <br /> The Conservation Commission has approved extensive installation of <br /> environmentally-friendly landscaping on the subject property as well as on the abutting <br /> i( property. An Order of Conditions was issued on September 10, 2012. '.... <br /> f4 <br /> The Board of Health is limiting the proposal to three bedrooms. <br />
