Impey Registry of Deeds Title Reference: <br /> 90 Captains Row Book: 15335 Page: 231 <br /> Map 96 Parcel 11 <br /> Mashpee, MA 02649 <br /> A Petition was filed on October 23, 2012 by Kathleen A. Impey requesting a <br /> Special Permit under §174-25.I(9) of the Zoning By-laws to allow for construction of a <br /> pier, ramp and float proposed to extend across a total of more than seventy (70) feet of <br /> coastal beach, coastal bank, salt marsh or bordering vegetated wetlands on property <br /> located in an R-3 zoning district at 90 Captains Row (Map 96 Parcel 11) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 23, and <br /> November 30, 2012, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> December 12, 2012. The following members of the Board were present and acting <br /> throughout: Board Members Jonathan D. Furbush, William A. Blaisdell, and Ronald S. <br /> Bonvie, and Associate Members Jolm M. Dorsey and Domingo K. DeBarros. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. John Slavinslcy from Cape & Islands Engineering represented the Petition <br /> and stated that plans call for construction of a dock that extends 97 feet from the mean <br /> high water mark. The extra dock length is necessary in order to access deeper water. <br /> Mr. Slavinslcy said that the proposal was reduced 12 feet in length, at the request of the <br /> Harbormaster, in order to line up with the abutters' docks. <br /> The Conservation Commission approved the proposal and issued an Order of <br /> Conditions on November 27, 2012. Shellfish Constable Richard York's November 15, <br /> 2012 email states that the proposal will not pose a problem for shellfish. <br /> Mr. James Boutilier, 44 Buccaneer Way, President of the Cove Association said <br /> that he expressed his concerns with Mr. Slavinslcy about access to the swim beach. <br /> After reviewing the plans, he said that he has no objections to the proposal. No other <br /> comments were received from abutters. <br /> Not having received any correspondence from the Waterways Commission or <br /> the Harbormaster, Mr. Blaisdell said that the ZBA will apply the following By-law: <br />
