She also provided copi s of the I PD S <br /> General Permit Annual Report, prepared by Catherine Laurent, DPW. <br /> Discussion <br /> Mashpee Commons Job's Fishing load Commercial Special Permit <br /> The Chairman reminded the Board that Mashpee Commons has received a <br /> Comprehensive Permit from the Zoning Board of Appeals for the 40B residential and <br /> commercial project. A Special-Permit for the commercial portion of the project has been <br /> granted by the Cape Cod Commission. <br /> There is disagreement as to whether or not Mashpee Commons is required to <br /> appear before the Planning Board for a Special Permit for the commercial portion of'the <br /> project. The Town Planner is ofthe opinion that they do have to appear before the <br /> Planning Board, to which Town Counsel agrees. However, Mashpee Commons counsel <br /> is of the opposite opinion. <br /> The Planning Board has notified the Building Inspector of their position as well as <br /> Town Counsel opinion, and has requested that no'building permits be issued until such <br /> time as Mashpee Commons appears before the Planning Board and obtains a Special <br /> Permit for the commercial portion of the project. <br /> The Town Manager has proposed a meeting with Mashpee Commons, their legal <br /> counsel, the Town Planner, herself, Town Counsel, and Beverly Kane as Chairman of the <br /> Planning Board. <br /> Beverly Dane reported that she has made a decision on behalf of the Planning <br /> Board to decline attending such a meeting due to the fact the Planning Board'had no <br /> knowledge of said meeting and that there had been no opportunity for Board discussion at <br /> a Planning Board meeting in which to direct the Chairman to attend such a meeting. <br /> It is the understanding of the Town Manager that Town Counsel has not wavered <br /> from his initial decision and that she supports his decision. <br /> It has been indicated via e-mail that Mashpee Commons and their counsel are <br /> willing to discuss the matter further with Town Counsel. <br /> The Town Planner informed the Board that a meeting is scheduled for Friday, <br /> November What :00 p.m. and that he intends to attend and point out those issues for <br /> review by the Board, the Commercial Center Bylaw, parking standards, and storwater <br /> treatment. <br /> Farewell, Harvey Cohen, Planning Board Associate Member <br /> The Chairman wished Harvey well on his relocation to Brookline. <br /> 1 <br />
