Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 7, and January 14, <br /> 2011, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on January <br /> 26, 2011. The following Board members were present and acting throughout: Board <br /> Members Robert G. Nelson, Jonathan D. Furbush, James Reiffarth, and John M. Dorsey <br /> and Associate Board Member Peter R. Hinden. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Michael Borselli, an engineer from Falmouth Engineering, represented the <br /> Petition. He stated that the homeowners wish to construct a private, recreational pier, <br /> ramp and float on the subject property. The proposal will be constructed of timber and <br /> pile-supported by 10-inch diameter pilings that will be spaced 18 feet on center with a <br /> four-foot wide walkway. This will be elevated above the salt marsh to provide for public <br /> access underneath in accordance with the provisions of Chapter 91. This will also allow <br /> for adequate sunlight penetration under and around the structure to prevent shading of the <br /> salt marsh. Fifty-percent sunlight-penetration decking material will also be used. Plans <br /> call for a 16-foot long ramp with an 8x20-foot float. Mr. Borselli said that the length of <br /> the structure is necessary due to the shallow water depth in that area. <br /> The proposal has received Conservation Commission and Shellfish approval. <br /> The Board expressed concern with safety issues since the parcel has not yet been <br /> developed. The Board discussed stipulating that construction of the dwelling on the <br /> property shall be constructed prior to issuance of the building permit for the pier, ramp <br /> s and float. Mr. Borselli said that would not present a problem for the Petitioner. <br /> Mr. Joseph Colasuonno, a direct abutter at 27 Sand Dollar Lane, said that he is not <br /> opposed to the proposal.
