Perry for a <br /> Special Permit under Section 174-45.4 of the Zoning By-laws for permission to construct <br /> an accessory apartment to an existing dwelling on property located in an R-5 zoning <br /> district at 6 Autumn Drive (Map 22 Parcel 10B) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on January 7, and January 14, 2011, a copy of <br /> which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on January <br /> 26, 2011. The following Board members were present and acting throughout: Board <br /> Members Robert G. Nelson, Jonathan D. Furbush, James Reiffarth, and John M. Dorsey <br /> and Associate Board Member Ronald S. Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. and Mrs. Thomas J. Perry stated that they have owned the home since 1990. <br /> The home was built with two bedrooms in the upper level and one bedroom with a <br /> bathroom in the basement. Plans call for converting the existing space in the walk-out <br /> basement into an accessory apartment with the addition of a kitchen. Mr. Perry submitted <br /> photos of the dwelling and clarified details of the proposal for the Board. <br /> The proposal has received Design Review Committee and Plan Review Committee <br /> approval. The Board of Health has restricted the dwelling to three bedrooms. At 525 <br /> square feet, the gross floor area of the proposed accessory apartment is not less than the <br /> required 300 square-foot minimum nor exceeds the 40% of the gross floor area of the <br /> structure. <br /> No comments were received from abutters. <br />
