MASHPEE ZONING BOARD OF APPEALS <br />• FEBRUARY 23, 2011 <br />MINUTES <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, February <br />23, 2011 at 7:00 p.m. (Conference Room #1) at the Mashpee Town Hall. Board <br />Members Robert G. Nelson, Jonathan D. Furbush, William A. Blasidell, John M. <br />Dorsey and Associate Board Member Ronald S. Bonvie were present. Associate Board <br />Members Peter R. Hinden and Judith Horton were not in attendance. <br />Chairman Robert G. Nelson opened the hearings at 7:00 p.m. and announced that the <br />meeting was being broadcast live. <br />NEW HEARING <br />Susan L. Karelitz: Requests a Variance from Section 174-33 of the Zoning By-laws to <br />vary the setback requirements from water and wetlands to allow for construction of a <br />pool, patio, retaining wall and additions to an existing home on property located in an <br />R-3 zoning district at 384 Monomoscoy Road (Map 125 Parcel 20) Mashpee, MA. <br />Sitting: Board Members Robert.G. Nelson, Jonathan D. Furbush, William A. Blaisdell, <br />John M. Dorsey and Associate Board Member Ronald S. Bonvie. <br />• Mr. John Slavinsky from Cape & Islands Engineering represented the Petition. He said <br />that the Petitioner has owned the subject property for approximately eight months. The <br />proposal calls for expansion of the patio, pool and deck. Mr. Slavinsky said that the <br />Petitioner is seeking relief of 20 feet from the setback requirements from the wetlands <br />to the pool. He stated that the Conservation Commission determined that there are two <br />resource areas — a salt marsh and bordering vegetated wetlands (BVW). <br />Mr. Slavinsky said that the situation has changed since 1999 and it has been detennined <br />that the area is a wetland, but stated that Conservation determined that it is not a <br />`performing' wetland. Conservation Agent Drew McManus stated that the proposed <br />landscaping plan was a great opportunity to enhance the bordering vegetated wetland <br />that abuts the salt marsh. The Conservation Commission has issued an Order of <br />Conditions. Mr. Slavinsky said that removal of 3,000 feet of turf will eliminate 14 <br />pounds of nitrogen a year. There are no plans to increase the foundation size. <br />Mr. Nelson pointed out the high water mark on the plan. He said that the high water <br />mark is not the same as the upland. Mr. Bonvie agreed with Mr. Nelson. He stated that <br />he has some background on the issue having served for 15 years on the Conservation <br />Commission in the town of Mansfield. <br />Mr. Mark Scofield of 378 Monomoscoy Road stated that he is in support of the project. <br />Mr. Nelson read the Board of Health memo stating that the proposal consists of <br />. expansion of an existing bedroom and will only require a septic system inspection. <br />
