Cleary Certificate of Title: 149281 <br /> 19 Tide Run Land Court Lot#: 5 <br /> Mashpee, MA 02649 Plan#: 35464-B Sheet 1 <br /> Assessor's Map 126 Parcel 41 <br /> A Petition was filed on March 15, 2011 by Nancy J. Cleary for a Variance from <br /> Section 174-33 of the Zoning By-laws for permission to vary the setback from water or <br /> wetland to allow for construction of a screened porch onto an existing dwelling on <br /> property located in an R-3 zoning district at 19 Tide Run (Map 126 Parcel 41) Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 25, and April 1, <br /> 2011, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on April 13, <br /> 2011. The following members of the Board were present and acting throughout: Board <br /> Members Robert G. Nelson, Jonathan D. Furbush, William A. Blaisdell, James Reiffarth <br /> and John M. Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Timothy Luff of Archi-Tech Associates represented the Petition and stated <br /> that the proposal calls for the addition of 47 square feet of a screened porch onto the <br /> existing deck. The existing deck is 18 feet from water or wetland and the proposal will <br /> be 24 feet away at its closest point. The Petitioner is seeking Variance relief to allow for <br /> construction of the porch. Lot coverage will increase from 24.43% to 24.79%. <br /> The Conservation Commission has issued an Order of Conditions on the proposal. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS: <br /> The subject property is located at 19 Tide Run and consists of 15,172 square feet of land. <br /> l <br />
