Dennis Assessor's Map 1 Parcel 13 <br /> 19 Park Road Book: 24907 Page: 284 <br /> Mashpee, MA 02649 <br /> A Petition was filed on March 1, 2011 by Jeffrey T. and Christine J. Dennis of <br /> Sandwich, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws to <br /> vary the front, side and lot coverage requirements to allow for construction of a deck onto <br /> an existing home on property located in an R-5 zoning district at 19 Park Road (Map 1 <br /> Parcel 13) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 25, and April 1, <br /> 2011, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on April 13, <br /> and April 27, 2011. The following members of the Board were present and acting <br /> throughout: Board Members Robert G. Nelson, Jonathan D. Furbush, William A. <br /> Blaisdell and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of.Mashpee <br /> Zoning By-laws. <br /> At the April 13, 2011 Public Hearings, Mr. and Mrs. Dennis, represented their <br /> Petition. They said that they purchased the home in October 2010 as a rental property. <br /> The proposal calls for addition of a deck to the home. Mrs. Dennis said that other homes <br /> in the area have decks similar to her proposal. She said the deck would enhance the <br /> value, appeal and living space of the home with a view of the water. Mr. Hinden asked if <br /> they would consider addition of a patio rather than a deck. Mrs. Dennis said that cars <br /> parked in the neighboring driveways block the view to the water from ground level of a <br /> patio. <br /> Letters in approval of the proposal were sent by direct abutters Mr. and Mrs. <br /> Donald Tucci of 17 Park Road and Mr. and Mrs. Thomas Newton of 18 East Road. <br /> Several of the Board members said that they visited the site and expressed <br /> concern with the crowded neighborhood and close proximity of the homes to one another. <br /> The Board also stated that lot coverage of 27%was excessive. <br /> After some discussion the Board suggested decreasing the size of the deck and <br /> removing the existing shed in order to reduce the lot coverage. <br /> The Board voted to continue the hearing until April 27, 2011 to allow the <br /> Petitioner an opportunity to submit a revised plan with the above-referenced changes. <br />
