MASHPEE ZONING BOARD OF APPEALS <br /> Peter Costill <br /> 37 Monomoscoy Road West <br /> Mashpee,MA 02649 <br /> SP-2011-12 <br /> After a short discussion with the Board, Mr. Costill agreed to reduce the size and <br /> to move/rotate the location of the proposal. The Board voted to continue the Petitions <br /> until June 8, 2011 to allow for submission of revised plans. <br /> At the Public Hearings on June 8, 2011, Mr. John Slavinsky of Cape & Islands <br /> Engineering stated that the proposed boathouse has been reduced in size and has been <br /> relocated. The Conservation Commission has approved the project. The Board of Health <br /> has prohibited installation of any plumbing service to the boathouse. <br /> After discussing the plans at length,the Board decided to grant a Special Permit. <br /> GENERAL FINDINGS <br /> The subject property is located at 37 Monomoscoy Road West and consists of <br /> 5,635 square feet of land. <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-25.H(7): Private one or two-car garage, greenhouse, or dock as a <br /> principle use where the lot cannot be developed with a principle residential use, provided <br /> that there be no commercial use or storage, no sanitary facilities, no storage outside of <br /> buildings, that no structure exceed fifteen (15) feet in height and that all applicable <br /> setbacks and lot coverage requirements are met and approved, that a special permit for <br /> such use is approved by the Board of Appeals. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> • the subject property cannot be developed with a principle residential use, <br /> therefore,the boathouse (garage)is allowed as a principle use. <br /> • the Board of Health has prohibited installation of plumbing facilities in the <br /> structure. <br /> • at 14 feet in height, the proposal will not exceed the 15-foot height maximum <br /> allowed under the By-law. <br /> • the Petitioner met the criteria for grant of Variance relief ftom the front setback <br /> requirements from Overland Road and Monomoscoy Road West; from the <br /> setback requirements to Town-owned land; and the setback requirements to water <br /> and wetlands. <br /> In view of the foregoing, the Board determined that the Petitioner met the criteria <br /> for grant of a Special Permit. Upon motion duly made and seconded, the Zoning Board <br /> of Appeals voted unanimously at the Public Hearings on June 8, 2011 to grant a Special <br /> Permit to allow for construction of a boathouse on the subject property. <br /> This Decision is conditioned upon compliance with Cape & Islands Engineering <br /> Plan entitled: "PROPOSED BOATHOUSE LOCATED IN MASHPEE, MASS. <br /> PREPARED FOR PETER COSTILL, DATE: MAR.31.2008, REV'D MAY 15, 2008, <br /> MAY 20, 2008 JULY 11, 2008, MAY 15, 2011, MAY 31". <br /> 3 <br />
