Town of Mashpee <br /> y y; 16 Great JdAck load Arth. <br /> hlashpee,lVassachuseus 02649 <br /> MASHPEE ZONING BOARD OYAPPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2011-16 <br /> Susan Taylor,Trustee Map 27 Parcel 157 <br /> 502 Main Street Registry of Deeds Title Reference <br /> Mashpee,MA 02649 Book: 11497 Page:207 <br /> A Petition was filed on April 12, 2011 by Susan Taylor, Trustee, for a Special Permit <br /> under Section 174-51.13 of the Zoning By-laws for permission to install a.new sign exceeding . <br /> twenty square feet on property located in a C-2 zoning distriet.at 502 Main Street(Map 27 Parcel <br /> 157)Mashpee,MA. <br /> Notice was duly given to abutters in. accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town.of Mashpee, on April 22, and April.29, 2011 a copy of which is <br /> attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on May 11, 2011. <br /> The following members of the Board were present and acting throughout:Board Members Robert <br /> G, Nelson, Jonathan D. Furbush, William A. Blaisdell, James Reiffarth and Associate Member <br /> Ronald S.Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A§9 and the Town of Mashpee Zoning By-laws. <br /> Mr.Andrew Nixon, owner of The Fitness Company,,represented the Petition. He stated <br /> that the new signage will replace the existing sign and will utilize the same posts in the same <br /> location. Although the Petitioner did not appear to represent the Petition, the.proposal received <br /> Design Review'Committee approval at its April 19,2011 Meeting. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS: <br /> The subject property is located at 502 Main Street.and consists of approximately 5.59 acres of <br /> land. <br /> SPECIAL PERMIT CRITERIA: <br /> §174-51..Required Review and Permits. <br /> B. Except where permitted or proposed as part of development for which a special permit has <br /> been issued by, or is required from, the Planning.Board, any new sign exceeding twenty (20) <br /> square feet, and any awning sign, shall require a special permit from the Board of Appeals, in <br /> accordance with Article VI. <br /> In view of the foregoing,the Zoning Board of Appeals determined that the Petitioner met <br /> the.criteria necessary for granting of a Special Permit. Upon motion duly made and seconded,the <br /> Zoning Board of Appeals voted unanimously at the Public Hearings on May 11,2011 to grant the <br /> Special Permit to allow for installation of the sign. This Decision is conditioned upon compliance <br /> with the following: <br /> • The Fitness Company Sign-A-Rama design dated April 4, 2011 and approved by the <br /> Design Review Committee on April 19,2011. <br /> • The sign must be installed on the existing posts. <br />
