Notice was duly given to abutters in. accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town.of Mashpee, on April 22, and April.29, 2011 a copy of which is attached hereto and made a part hereof. Public Hearings were held on the Petition at the Mashpee Town Hall on May 11, 2011. The following members of the Board were present and acting throughout:Board Members Robert G, Nelson, Jonathan D. Furbush, William A. Blaisdell, James Reiffarth and Associate Member Ronald S.Bonvie. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A§9 and the Town of Mashpee Zoning By-laws. Mr.Andrew Nixon, owner of The Fitness Company,,represented the Petition. He stated that the new signage will replace the existing sign and will utilize the same posts in the same location. Although the Petitioner did not appear to represent the Petition, the.proposal received Design Review'Committee approval at its April 19,2011 Meeting. No comments were received from abutters. GENERAL FINDINGS: The subject property is located at 502 Main Street.and consists of approximately 5.59 acres of land. SPECIAL PERMIT CRITERIA: §174-51..Required Review and Permits. B. Except where permitted or proposed as part of development for which a special permit has been issued by, or is required from, the Planning.Board, any new sign exceeding twenty (20) square feet, and any awning sign, shall require a special permit from the Board of Appeals, in accordance with Article VI. In view of the foregoing,the Zoning Board of Appeals determined that the Petitioner met the.criteria necessary for granting of a Special Permit. Upon motion duly made and seconded,the Zoning Board of Appeals voted unanimously at the Public Hearings on May 11,2011 to grant the Special Permit to allow for installation of the sign. This Decision is conditioned upon compliance with the following: • The Fitness Company Sign-A-Rama design dated April 4, 2011 and approved by the Design Review Committee on April 19,2011. • The sign must be installed on the existing posts.
