Stevenson, et al, Trustees for <br /> a Special Permit under Section 174-25.I(9) to allow for construction of a pier, ramp and <br /> float that will extend across a total of more than seventy feet of coastal beach, coastal <br /> bank, salt marsh or bordering vegetated wetlands on property located in an R-3 zoning <br /> district at 431 Monomoscoy Road (Map 124 Parcel 53)Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 22, and April 29, <br /> 2011 a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on May 25, <br /> 2011. The following members of the Board were present and acting throughout: Board <br /> Members Robert G.Nelson, Jonathan D. Furbush and William A. Blaisdell and Associate <br /> Members Ronald S. Bonvie and Judith M. Horton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the Petition and <br /> stated that the Acting Harbormaster and Shellfish Constable have approved the proposal. <br /> The Conservation Commission has issued an Order of Conditions and is allowing a 36- <br /> foot walkway over the fragile marsh area, along with relocation of the proposed dock. <br /> The proposal will extend a total of 110 feet in order to accommodate Conservation's <br /> requirements. Mr. Slavinsky confirmed that the Petitioner owns all of the salt marsh area <br /> shown on the plan. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> The subject property is located at 431 Monomoscoy Road and consists of approximately <br /> 0.082 acres of land. <br />
