MASHPEE ZONING BOARD OF APPEALS <br /> Paul Tragiannopoulos <br /> 593 Main Street <br /> Mashpee,MA 02649 <br /> Finding of Fact: FoF-2011-29 <br /> 2. The Subject Property is located in an R-5 Residential Zoning District. <br /> 3. In 2010, the Zoning Board of Appeals granted the Petitioner a dimensional <br /> variance which would allow for construction of a hobby shop/garage on the <br /> Subject Property. Construction of the garage was recently halted,leaving a 7-inch <br /> slab on the ground. <br /> 4. The Petitioner is currently using the Subject Property to operate a vehicle/heavy <br /> equipment metal refinishing and refurbishing business. Said business entails the <br /> delivery to and storage of large vehicles, heavy commercial and industrial <br /> equipment on the Subject Property and the use of power tools, sandblasting <br /> equipment and other equipment used to remove rust,paint and other finishes from <br /> said vehicles and heavy equipment, and to repaint and refinish said vehicles and <br /> equipment. <br /> 5. The Petitioner's principal and only place of business for his vehicle/heavy <br /> equipment metal refinishing and refurbishing business is located on the Subject <br /> Property. The Petitioner does not have any other off-premises locations from <br /> which he conducts his vehicle/heavy equipment metal refinishing and <br /> refurbishing business. <br /> 6. The activities conducted by the Petitioner on the Subject Property produce <br /> substantial noise, vibrations, and emissions of odors, dust, fumes, smoke and <br /> other noxious components, including lead paint, into the environment. <br /> 7. The inherent character of these activities is industrial in nature, noxious, offensive <br /> and/or hazardous,both environmentally and otherwise. <br /> 8. Because of the substantial emissions of odors, dust, fumes, smoke and other <br /> noxious components, including lead paint, into the environment, the Petitioner's <br /> vehicle/heavy equipment metal refinishing and refurbishing business has a much <br /> larger environmental impact than that of a builder, carpenter, painter, mason or <br /> other similar artisan. <br /> 9. The Petitioner's vehicle/heavy equipment metal refinishing and refurbishing <br /> business operates very differently than that of a builder, carpenter, painter, mason <br /> or other similar artisan because it requires sandblasting and other similar <br /> operations which produce substantial noise, vibrations, and emissions of odors, <br /> dust, fumes, smoke and other noxious components, including lead paint, into the <br /> environment. <br /> 10. The Petitioner's vehicle/heavy equipment metal refinishing and refurbishing <br /> business has a much larger impact on traffic in this residential area than that of a <br /> builder, carpenter, painter, mason or other similar artisan because of the frequent <br /> 2 <br />
