Johnson, Trustee, for a Variance from Section 174-31 of the Zoning By-laws for permission to vary the lot coverage requirements to allow for installation of a pool on property located in an R-3 zoning district at 47 Godfrey Road (Map 96 Parcel 104K) Mashpee, MA. Petitioner: Kenneth E.Norcross. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on July 8, and July 15, 2011 a copy of which is attached hereto and made a part hereof. Public Hearings were held on the Petition at the Mashpee Town Hall on July 27, 2011. The following members of the Board were present and acting throughout: Board Members Robert G. Nelson, Jonathan D. Furbush, William A. Blaisdell and James Reiffarth and Associate Member Ronald S. Bonvie. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. Attorney Jack McElhinny represented the Petitioner, Mr. Norcross, who also attended the meeting. Attorney McElhinny stated that Mr. Norcross has been searching for a home in Mashpee for over two years. The subject property is under a purchase and sale agreement contingent upon ZBA approval of the pool. Mr. Norcross said that his adult handicapped daughter has been residing in a shared-living environment in Mashpee since 2005. Mr. Norcross is very eager to purchase this home and install a pool for his daughter who is blind and deaf. He taught his daughter how to swim when she was two years old and said that when she is in the water, she's liberated. Swimming is an integral part of her therapy. Looking forward to moving from a small condo to this more spacious home, Mr. Norcross will be able to accommodate extended family members and integrate them back into his life along with his daughter.
