Johnson, Trustee, for a <br /> Variance from Section 174-31 of the Zoning By-laws for permission to vary the lot <br /> coverage requirements to allow for installation of a pool on property located in an R-3 <br /> zoning district at 47 Godfrey Road (Map 96 Parcel 104K) Mashpee, MA. Petitioner: <br /> Kenneth E.Norcross. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on July 8, and July 15, 2011 a <br /> copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on July 27, <br /> 2011. The following members of the Board were present and acting throughout: Board <br /> Members Robert G. Nelson, Jonathan D. Furbush, William A. Blaisdell and James <br /> Reiffarth and Associate Member Ronald S. Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Attorney Jack McElhinny represented the Petitioner, Mr. Norcross, who also <br /> attended the meeting. Attorney McElhinny stated that Mr. Norcross has been searching <br /> for a home in Mashpee for over two years. The subject property is under a purchase and <br /> sale agreement contingent upon ZBA approval of the pool. Mr. Norcross said that his <br /> adult handicapped daughter has been residing in a shared-living environment in Mashpee <br /> since 2005. Mr. Norcross is very eager to purchase this home and install a pool for his <br /> daughter who is blind and deaf. He taught his daughter how to swim when she was two <br /> years old and said that when she is in the water, she's liberated. Swimming is an integral <br /> part of her therapy. Looking forward to moving from a small condo to this more <br /> spacious home, Mr. Norcross will be able to accommodate extended family members and <br /> integrate them back into his life along with his daughter. <br />
