This property is located in an R-5 zoning district at 14 Wilann <br /> Road (Map 46 Parcel 46) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 22, 2007 and June 29, <br /> 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 11, 2007, at which time the following members of the Zoning Board of <br /> Appeals were present and acting- throughout: Zella Elizenberry, Robert Nelson. Jonathan <br /> Furbush, James Reiffarth and George Bolton. <br /> The IN/Iasllpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Brian Garner of Dunning & Kirrane represents the applicants at this <br /> hearing. They are seeking landspace relief and frontage relief from the zoning by-laws in <br /> order to deem this lot buildable. The Board reviews the plans and discuss why section <br /> 174-21 is on the application. It is agreed that applicant strike that request and just use <br /> 174-31 on the application. Two neighbors Dave Almquist of 20 Wilann Road and Ken <br /> Roche of 30 Wilann Road speak to the Board and Attorney Garner with their concerns <br /> that they want homes built on this lot consistent with the other homes in the area. They <br /> do not want two small little houses built and then have their property values diminish. <br /> r <br />
