Yurek Certificate of Title#: 128415 <br /> 199 Daniels Island Road Land Court Lot#: 18, 19-A <br /> Mashpee,MA 02649 Plan#: 11408-C, 11408-G <br /> Map 100 Parcel 35 <br /> A Petition was filed on September 16, 2011 by Gregory J. and Carol L. <br /> Yurek for a Modification of Special Permit SP-94-61 to allow for the reconstruction <br /> of a garage and the construction of an addition that will connect to the house to the <br /> garage and to add a floor to the existing dwelling on property located in an R-3 <br /> zoning district at 199 Daniels Island Road (Map 100 Parcel 35), Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in the Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on September 23, and September 30, <br /> 2011, copy of which is attached hereto and made a part hereof. <br /> A Public Meeting was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 12, 2011 at 7:00 p.m., at which time the following members of <br /> the Zoning Board of Appeals were present and acting throughout: Robert G. Nelson, <br /> Jonathan D. Furbush, William A. Blaisdell, James Reiffarth and Ronald S. Bonvie <br /> The Petitioners were represented by Attorney Brian J. Wall of Troy Wall <br /> Associates and John Slavinsky of Cape and Islands Engineering, Inc. Mr. and Mrs. <br /> Yurek were present at the Hearing. The Petitioners' representatives informed the <br /> Board of the following: <br /> Mr. and Mrs. Yurek own the single-family dwelling and detached garage at <br /> 199 Daniels Island Road. The structures are non-conforming and exist pursuant to a <br /> Special Permit issued in 1994 (SP-94-61). The Yureks seek to modify the Special <br /> Permit in order to authorize the reconstruction of the garage and the construction of <br /> an addition that will connect the house to the garage and add a floor to the existing <br /> dwelling. The existing structures exceed the allowable lot coverage. The proposed <br /> addition will increase this non-conformity. The Petitioners are requesting a Finding <br /> by the Zoning Board of Appeals that the proposed project is not more substantially <br /> detrimental to the neighborhood than the existing structures. <br /> j <br />
