MASHPEE ZONING BOARD OF APPEALS <br /> Habitat for Humanity of Cape Cod, Inc. <br /> 19 Lakewood Drive <br /> Mashpee,MA 02649 <br /> Comprehensive Permit under MGL Chapter 40B <br /> CP-10-07 <br /> shall forthwith issue. Any person aggrieved by the issuance of a comprehensive permit or <br /> approval may appeal to the court as provided in Chapter 40A §17. <br /> FINDINGS <br /> 1. the subject property is located at 19 Lakewood Drive and consists of 11,388 square feet <br /> of land. <br /> 2. the subject property is an undeveloped parcel within an already developed and well- <br /> maintained neighborhood of single-family homes. <br /> 3. the proposal to a construct a single-family, three-bedroom, one and one-half story home <br /> will be compatible with the neighboring homes in the surrounding area. <br /> 4. the Petition for a Comprehensive Permit to build the home was accompanied by all the . <br /> appropriate documentation including the following: <br /> • Letter of Support dated October 6, 2009 confirming a unanimous vote by the <br /> Mashpee Board of Selectmen qualifying the Petition for affordable housing as a <br /> Local Initiative Project. <br /> • Article 16—Town Meeting of October 15, 2007,unanimously supporting the use <br /> of the subject parcel for affordable housing development. <br /> • Determination of Project Eligibility under the Local Initiative Program from the <br /> Department of Housing & Community Development dated January 22, 2010. <br /> 5. the proposed residence will be maintained as affordable housing in perpetuity. <br /> 6. the urgent need for development of low income and affordable housing in the Town of <br /> Mashpee outweighs the Town's interest in strict adherence to the minimum lot size, <br /> frontage and setback requirements. <br /> 7. the Petitioner, Habitat for Humanity of Cape Cock, Inc., has an extensive background and <br /> reputation for developing successful affordable housing projects on Cape Cod. <br /> In view of the foregoing and upon motion duly made and seconded, the Mashpee Zoning <br /> Board of Appeals voted unanimously on March 10, 2010 to grant the Petitioner the following on <br /> the property located at 19 Lakewood Drive: <br /> • a Comprehensive Permit under Massachusetts General Laws Chapter 4013. <br /> • a variance of 68,612 square feet from the lot size requirements. <br /> • a variance of 60 square feet from the lot frontage requirements. <br /> • a variance of 5 feet from the front setback requirements. <br /> This Decision is conditioned upon compliance with plan entitled: "Habitat for Humanity of <br /> Cape Cod 657 Route 28, West Yarmouth, MA 02673 Site & Sewage Disposal System Design 19 <br /> Lakewood Drive, Mashpee, MA J.
