MASHPEE ZONING BOARD OF APPEALS Habitat for Humanity of Cape Cod, Inc. 19 Lakewood Drive Mashpee,MA 02649 Comprehensive Permit under MGL Chapter 40B CP-10-07 shall forthwith issue. Any person aggrieved by the issuance of a comprehensive permit or approval may appeal to the court as provided in Chapter 40A §17. FINDINGS 1. the subject property is located at 19 Lakewood Drive and consists of 11,388 square feet of land. 2. the subject property is an undeveloped parcel within an already developed and well- maintained neighborhood of single-family homes. 3. the proposal to a construct a single-family, three-bedroom, one and one-half story home will be compatible with the neighboring homes in the surrounding area. 4. the Petition for a Comprehensive Permit to build the home was accompanied by all the . appropriate documentation including the following: • Letter of Support dated October 6, 2009 confirming a unanimous vote by the Mashpee Board of Selectmen qualifying the Petition for affordable housing as a Local Initiative Project. • Article 16—Town Meeting of October 15, 2007,unanimously supporting the use of the subject parcel for affordable housing development. • Determination of Project Eligibility under the Local Initiative Program from the Department of Housing & Community Development dated January 22, 2010. 5. the proposed residence will be maintained as affordable housing in perpetuity. 6. the urgent need for development of low income and affordable housing in the Town of Mashpee outweighs the Town's interest in strict adherence to the minimum lot size, frontage and setback requirements. 7. the Petitioner, Habitat for Humanity of Cape Cock, Inc., has an extensive background and reputation for developing successful affordable housing projects on Cape Cod. In view of the foregoing and upon motion duly made and seconded, the Mashpee Zoning Board of Appeals voted unanimously on March 10, 2010 to grant the Petitioner the following on the property located at 19 Lakewood Drive: • a Comprehensive Permit under Massachusetts General Laws Chapter 4013. • a variance of 68,612 square feet from the lot size requirements. • a variance of 60 square feet from the lot frontage requirements. • a variance of 5 feet from the front setback requirements.
