Mashpee Zoning Minutes <br />Board of Appeals April 14, 2010 <br />MASHPEE ZONING BOARD OF APPEALS <br />MINUTES <br />• April 14, 2010 <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, April 14, <br />2010, at the Mashpee Town Hall. Board Members Robert G. Nelson, Jonathan Furbush, <br />James Reiffarth, William Blaisdell, John Dorsey and Associate Members Peter Hinden <br />and Ronald S. Bonvie were present. <br />Mr. Nelson opened the meeting at 7:00 p.m. <br />INFORMAL DISCUSSION <br />Kevin M. Kirrane: Informal discussion of proposed Modification to a Special Permit <br />(SP -09-18) 8 Chart Way, Mashpee, MA. <br />Attorney Kevin M. Kirrane represented the Petitioner, Shane T. Caiazzo, who was also in <br />attendance at the meeting. Attorney Kirrane referred to the Special Permit granted by the <br />Board in 2009 allowing the Petitioner to demolish an existing building and rebuild a new <br />home on the subject property. The pool on the original plan approved by the Board was <br />located in such a way that anyone exiting the house would walk right into the pool. <br />Attorney Kirrane said that the Petitioner would like to make a minor modification to the <br />Special Permit SP -09-18 to allow for slight relocation of the pool. The proposed new <br />location of the pool is actually farther away from the wetlands than the previous location. <br />• Attorney Kirrane submitted the new plan and asked if the Board would agree to accept <br />the new plan as part of the record in order to allow the Petitioner to continue <br />construction. <br />• <br />Mr. Nelson said that he met with Building Inspector Richard Stevens on Monday, April <br />12, 2010. The Conservation Commission has approved the new plan. Mr. Nelson said <br />that he and Mr. Stevens agreed that it would be appropriate for the ZBA Chairman to <br />note the minor revision on the plan and then initial it. Mr. Nelson asked for comments <br />from the other Board members. Mr. Dorsey said that he had no problem with the <br />proposal and that it was an improvement on the setback to the wetlands. The other Board <br />members also agreed. <br />James Shalek: Requests a six-month extension of Variance V-09-23 on property located <br />in an R-3 zoning district at 127 Popponesset Island Road (Map 112 Parcel 18) Mashpee, <br />MA. <br />Attorney Kevin Kirrane represented the Petitioner, James Shalek, who also attended the <br />meeting. Attorney Kirrane said that the request for an Extension of the above -referenced <br />Variance is due to unfavorable economic conditions that made it difficult for the <br />1 <br />
