Paulding, Sr., Trustee, Makedo Realty <br /> Trust, for a Variance from Section 174-31 of the Zoning By-laws for permission to vary the rear <br /> setback requirements to allow for construction of a commercial building on property located in an <br /> I-1 zoning district at 64 Industrial Drive (Map 88 Parcel 34)Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on April 23 and April 30, 2010, a copy of which is <br /> attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, <br /> May 12, 2010, at which time the following members of the Board were present and acting <br /> throughout: Robert G. Nelson,Jonathan Furbush, James Reiffarth,John M. Dorsey and Ronald S. <br /> Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Law, Chapter 40A, Section 10 and the Town of Mashpee Zoning By-laws. <br /> Mr. John Slavinsky from Cape & Islands Engineering represented the Petitioner. Mr. <br /> Scott Jones, who plans to purchase and develop the subject parcel, was also in attendance. Mr. <br /> Slavinsky stated that the proposal calls for construction of a commercial building on the property. <br /> The plan meets the front setback and side setback requirements. Although the proposed building <br /> has been reduced in size, it still does not conform to the rear setback requirements. The proposal <br /> will not exceed the maximum 25%lot coverage requirement. <br /> The Board of Health has approved plans which include the installation of an Innovative <br /> Alternative denitrification system on the subject property. The proposal requires a Special Permit <br /> from the Planning Board. The proposal is also subject to Plan Review and Design Review <br /> Committee approval. <br /> 1 <br />
