DeFrancesco <br /> of Mashpee, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws <br /> for permission to vary the side and front setback requirements to allow for construction of <br /> an addition to an existing home on property located in an R-5 zoning district at 80 <br /> Scituate Road(Map 22 Parcel 79)Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 9, and April 16, <br /> 2010, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on April 28, <br /> 2010. The following members of the Board were present and acting throughout: Robert <br /> G. Nelson, Jonathan Furbush, James Reiffarth, John M. Dorsey, Peter Hinden. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mrs. Sharon A. DeFrancesco represented her Petition. The proposal is for <br /> addition of a mudroom and a front porch. Mrs. DeFrancesco said a minor revision to the <br /> plan calls for enclosing 18 feet of the porch in order to create a foyer. She submitted a <br /> plan and explained that the footprint of the proposal would remain the same. <br /> Mr. Nelson read the letter from the Board of Health stating that the proposal will <br /> require a septic inspection. <br /> Mr. Nelson pointed out that the abutting houses are closer to Scituate Road than <br /> the subject property is. He said that the Board could apply the"average setback rule"had <br /> the abutting houses been included on the plan. This would eliminate the need for <br /> Variance relief.
