MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 12,2022 <br /> Mr. Furbush asked for comments from Chris Gallaher, Town Engineer. He said that the <br /> new structure will be raised 4 ft. above the flood plain. The first floor will be raised 5 ft. <br /> above the previous. Based on his calculations, he believes the structure will be 3 stories. <br /> There were no dimensions on the building plans or on the site plans. He also mentioned <br /> that the Board of Health Agent has not approved a septic system. <br /> Attorney Kirrane mentioned that this is a departure from what the Board has interpreted in <br /> the past. The bylaw does not say existing natural grade. He said maybe the Board should <br /> review the wording of the bylaw. <br /> George read the Conservation Department into the record. He read the Board of Health <br /> comments into the record, and Town Engineer comments. <br /> Mr. Furbush suggested that the hearing be continued until the Board of Health, Building <br /> Commissioner, and Town Engineer are satisfied. <br /> Attorney Kirrane said he will accept the extension until January 26, 2022. <br /> Mr. Reidy asked Attorney Kirrane if two weeks would be enough time to meet with the <br /> Board of Health. Attorney Kirrane said he will talk with the builder, and if more time is <br /> needed he will send a formal letter. <br /> Mr. Reidy made a motion that the Board accept the request for a continuance until January <br /> 26, 2022. Mr. Ganzenmuller, seconded, yes. Mr. Caggiano, yes, Mr. Reidy, yes, Mr. <br /> Blaisdell, yes, and Mr. Furbush yes. All were in favor of the continuance. <br /> Sitting on this hearing are Chairman Furbush, Mr. Blaisdell, Mr. Reidy, Mr. Pittsley, and <br /> Mr. Caggiano. <br /> 54 Bayberry Dr.: Petitioner, Mark Culhane requests a Variance from the front and side <br /> yard setbacks under §174-31 of the Zoning Bylaws to allow for an addition, extension to <br /> an existing three bedroom dwelling on property located in an R-5 Zoning District, Map 23 <br /> Parcel 202, Mashpee, MA. (Owner of Record: Thora J. Christo). <br /> 54 BaN,berry Dr.,: Petitioner, Mark Culhane requests a Written Finding under §174-17 of <br /> the Zoning Bylaws to allow for an addition, extension to a pre-existing, non-conforming <br /> structure on property located in an R-5 Zoning District,Map 23 Parcel 202,Mashpee,MA. <br /> (Owner of Record: Thora J. Christo). <br /> Mr. Mark Culhane represented the application for the Written Finding and Variance. The <br /> property is non-conforming on the North East side. The current front setback is 29.8 ft. <br /> which will stay the same with the proposed addition. On the Northwesterly side is currently <br /> at 30.3 ft. and will be moved 9.4 ft.The property is on a corner lot that runs along Cranberry <br /> Lane which is ends at the property line. <br /> 5 <br />
