Town <br /> ' s � 16 Great Xeck !oad Xorth <br /> firs Mashpee, Massachusetts 02649 , <br /> Mashpee Planning Board <br /> Public Hearing Notice { <br /> r <br /> 1 <br /> Pursuant to Massachusetts General Laws, Chapter 40A,the Mashpee Planning Board will hold a <br /> public hearing on Wednesday, September 16, 1998 at 7:00 p.m. at the Mashpee Town Hall, 16 <br /> Great Neck Road North to review the following <br /> . � g zoning amendment articles for action at the <br /> October 5, 1998 Annual Town Meeting. Summaries of the articles are as follows: <br /> +i <br /> 1. This article, which is based on a model bylaw prepared by the Cape Cod Commission, would <br /> authorize the Town to prepare and enter into long-term "development agreements" with <br /> developers,the Cape Cod Commission, adjacent towns and state agencies. Agreements would be <br /> negotiated by the Planning Board but would require approval by the Board of Selectmen. Such <br /> agreements would be binding contracts spelling out <br /> + the terms under which a project could be completed over a number of years, <br /> ■ what infrastructure, other Town facilities and programs, open space or other items of benefit <br /> p p , <br /> to the Town would be provided by the developer, <br /> • what impact fees would be paid, <br /> • what protections the developer might obtain from subsequent zoning and regulatory changes, <br /> • what streamlined permitting procedures might be established for construction done under the <br /> terms of the agreement and <br /> • other items of mutual interest between the parties to the agreement. <br /> The Town's ability to enter into such agreements is predicated on the Town having a Local .s <br /> Comprehensive Plan certified by the Cape Cod Commission as being consistent with the county's <br /> Regional Policy Plan. <br /> 2. This article would amend the zoning bylaw by adding the words "or Commonwealth of <br /> Massachusetts"after the phrase "is acquired by the town" in the first sentence of Subsection 174- <br /> 28.C. That Subsection currently provides that if land is taken b the Town, or donated to the <br /> p y , <br /> Town, for roadway or utility purposes, the parcel from which the land is acquired will be treated, <br /> for the purpose of calculating lot size, setbacks, allowed lot coverage etc., as if the parcel still <br /> included the land that was acquired.
