As the first order of business he recognized <br /> Mr. Fitch, who identified himself for the record as John Fitch, <br /> an Attorney, representing Phyllis Thompson, owner of said <br /> property, from May 1993 at which time their Subdivision Plan <br /> was approved. In part, it was agreed that the owner of the <br /> property would donate land and engineering to improve Pimlico <br /> Pond Road. 1 . <br /> Attorney Fitch made reference to Plan entitled, "Three <br /> Ponds, Mashpee, MA. , for George H. Thompson, July 6, 1988011 !� <br /> (There was discussion regarding abandonment of the old road, DPI <br /> construction, Town Meeting Article authority to abandon, <br /> relocation, County Way, and the status of the utilities. ) He <br /> explained that his clients are interested in selling one side <br /> of Pimlico Pond Road, as a package, subject to the Covenant. <br /> Attorney Fitch requested a vote of the Planning Board to r <br /> l subject to the existing approve the sale, s � g Covenant. He proposed <br /> preparingthe following three documents for submission to the A <br /> PlanningBoard at a future date: Release of the Covenant <br /> �. <br /> (referencing the release of one Covenant and the creation of two <br /> (2) new Covenants referencing the breakdown of said Lots for <br /> recording. <br /> Attorney Fitch then pointed out an error. There was to be <br /> . <br /> no Lot access off Pimlico Pond Road, everything was to access <br /> internally (with the exception of Lot 6) . An Agreement was signed and recorded on Conditions of Approval, in which it states that r: <br /> Lot 7 shall derive its vehicular access exclusively from Bast <br /> Road. The last Amendment allowed for a driveway Basement, <br /> thereby contradicting in the Condition. He requested permission to <br /> amend the Conditions of Approval for recording. <br /> The PlanningBoard approved both requests, Attorney Fitch <br /> � <br /> 1 <br /> I I <br />
