As the first order of business he recognized l: ' <br /> Mr. Giatrelis, who identified himself for the Record as Stephen <br /> Giatrelis, 106 Cape Drive, Mashpee, Massachusetts. <br /> Mr. Giatrelis presented a Plan, 525 Main Street, Assessor' s <br /> Map 26, Parcel S, Book 912, Page 227. There exists on said , <br /> Parcel a mobil <br /> P e home w/additions and concrete foundations. He is , <br /> proposing the creation of three (3) lots in the residential <br /> zone. <br /> This property is zoned Commercial, Industrial and Residential (R5 '�; <br /> and C2) . (There was some discussion regarding lot size and <br /> n <br /> frontage. ) , <br /> Mr. Giatrelis explained he had appeared before the Zoning <br /> Board of Appeals asking for a variance for an increase in <br /> frontage (from 175 f t. to 200 ft. ) in order to create three lots. <br /> Due to objections from an abutter, the Board of Appeals referred <br /> him to the Planning Board in order to meet the frontage <br /> requirement of 200 feet on the Commercial property, creating a 25 :._ <br /> foot strip of land. The Chairman noted this would create '` <br /> Commercial frontage in a Residential district. <br /> The Chairman suggested this issue remains a Board of Appeals ISor <br /> matter and advised Mr. Giatrelis to seek legal. counsel . (There <br /> was some discussion pre-existing non-conforming/conforming lot; <br /> commercial/residential. frontage; zoning bylaw. ) <br /> Thomas <br /> Fudal a rel aged Town Counsel' s opinion, which i s to <br /> Obtain a variance from the Board of Appeals on frontage and to <br /> then proceed with a Definitive Subdivision Plan. (Town Counsel <br /> is not in agreement with the Board of Appeals Decision in this <br /> pP <br /> matter. ) <br /> The <br /> Chairman suggested Mr. Giatrelis confirm with his <br /> attorney valid frontage/use.
