Baker Book 22583 Page 240 <br /> 116 Main Street Assessor's Map 46 Parcel 70 <br /> Mashpee, MA 02649 <br /> A Petition was filed on May 3, 2010 by Mark A. Baker of Taunton, <br /> Massachusetts for a Finding of Fact under Section 174-17 of the Zoning By-laws for <br /> permission to demolish and replace a pre-existing, non-conforming dwelling on property <br /> located in an R-5 zoning district at 116 Main Street (Map 46 Parcel 70)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on May 7, and May 14, 2010, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on May 26, <br /> 2010. The following members of the Board were present and acting throughout: Robert <br /> G. Nelson, Jonathan Furbush, James Reiffarth, Peter Hinden and Ronald S. Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Baker represented his Petition and stated the existing dwelling on the subject <br /> property has been condemned. The proposal calls for demolition of the existing dwelling <br /> and construction of a new home. The proposed construction will conform to the setback <br /> requirements. Mr. Balser said that the garage has been repaired and will remain on the <br /> property. He said that he plans to reduce the size of the driveway and replace some of <br /> that concrete and asphalt area with natural vegetation. <br /> The Board agreed that the property is a pre-existing lot and does not require <br /> Variance relief from the lot frontage and lot size requirements. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS: <br /> that the subject property is located at 116 Main Street and consists of 43,560 <br /> square feet of land. <br />
