The <br /> Petition requested an extension of the property's use to a year-round motel with <br /> nine of nineteen units to be used for occupants staying for intervals greater than <br /> thirty days. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on May <br /> 21, and May 28, 2010, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> June 9, July 14, and August 11, 2010. The following members of the Board were <br /> present and acting throughout: Robert G. Nelson, Jonathan Furbush, William A. <br /> Blaisdell, James Reiffarth and Peter R. Hinden. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to <br /> the provisions of Massachusetts General Law and the Town of Mashpee Zoning <br /> By-laws. <br /> FINDINGS: <br /> 1. The subject property is located at 66-72 Main Street and consists of <br /> 42,568 square feet of land (hereinafter"Subject Property"). <br /> 2. The Subject Property is located in an R-5 Zoning District. <br /> 3. Located on the Subject Property is the Plaza Del Sol Motel. <br /> 4. The current pre-existing, non-conforming use of the Subject Property is a <br /> year round motel. <br /> 5. The Subject Property currently has 19 units. <br /> 6. The property known and numbered 78 Main Street, Mashpee, MA is not <br /> part of the Subject Property and is not owned by the Petitioner. <br /> 7. The property known and numbered 78 Main Street, Mashpee, MA is owed <br /> by the Nivaas Corporation. <br /> 8. The property located to the rear of the Subject Property is owned by <br /> owners unknown. <br /> j <br />
