1/p'ry 7 x'n of Mashpee
_.
. / 16 Great ffeck&ad,N rth
4r57;, Alaslipee, Massachusetts 02649
MASHPEE ZONING BOARD OF APPEALS
DECISION FOR A VARIANCE
V-10-25
Doris K. Perillo, Trustee Assessor's Map 117 Parcel 257
Sacchetti Realty Trust Certificate of Title: 178862
4 Pond Street
Mashpee, MA 02649
A Petition was filed on May 20, 2010 by Doris K. Perillo of Dedham, Massachusetts for
a Variance from Section 174-31 of the Zoning By-laws to vary the lot coverage requirements
and the front setback requirements from Pond Street to allow for construction of a deck to an
existing home on property located in an R-3 zoning district at 4 Pond Street (Map 117 Parcel
257) Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General Laws
Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of
general circulation in the Town of Mashpee, June 4, and June 11, 2010, a copy of which is
attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on June 23, 2010.
The following members of the Board were present and acting throughout: Board Members
Robert G. Nelson, Jonathan Furbush and William Blaisdell, and Associate Members Peter
Hinden and Ronald S. Bonvie.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions
of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws.
Mr. and Mrs. Perillo represented the Petition. Mr. Perillo stated that the size of the deck
is required to provide accommodation for two handicapped people living in the home. He said
that construction of the deck was undertaken and it became apparent that there was not enough
room for handicap access. The Petitioner halted construction in order to Petition for a Variance
from the Zoning Board of Appeals because increasing the size of the deck will increase the
percentage of lot coverage and will also encroach into the front setback requirements. Mrs.
Perillo explained that her two sisters live in the home, both of whom use wheelchairs. There is
an oversized door accessing the deck.
No comments were received from abutters.
