Carpenter Assessor's Map 58 Parcel 13 <br /> 75 Cayuga Avenue Registry of Deeds <br /> Mashpee, MA 02649 Certificate of Title: 165804 <br /> A Petition was filed on August 2, 2010 by Ronald M. and Kristine M. <br /> Carpenter for a Special Permit under Section 174.45.4 of the Zoning By-laws for <br /> permission to legalize an existing accessory apartment on property located in an <br /> R-3 zoning district at 75 Cayuga Avenue(Map 58 Parcel 13)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on August <br /> 6, and August 13, 2010, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> August 25, 2010. The following Board members were present and acting <br /> throughout: Board Members Jonathan Furbush, William A. Blaisdell and James <br /> Reiffarth and Associate Board Members Peter R. Hinden and Ronald S. Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mrs. Kristine M. Carpenter represented the Petition seeking a Special <br /> Permit for the existing accessory apartment. In 2001, the Board granted a Special <br /> Permit to the previous owners of the home allowing for the accessory apartment. <br /> The Special Permit lapsed upon sale to the current owners. Mrs. Carpenter said <br /> that the gross floor area of the apartment does not exceed the allowed 40% of the <br /> gross floor area of the structure. She also said that there is sufficient parking on the <br /> subject property. <br /> Mr. Blaisdell read a letter in favor of the Petition from Mr. James E. Regan, <br /> a direct abutter at 67 Cayuga Avenue. <br /> The accessory apartment was inspected by Fire Inspector,Joel Clifford and <br /> was found to be in compliance with 527 (CMR) Codes of Massachusetts <br /> Regulations. <br />
