Town of�'lc�shpee <br /> 28 Great.aJVeck�aac�zJ�cirC]i <br /> .: lalaslij�ee,.la'lassachttsetts 02649.: <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-10-34 <br /> David M. and Ana Ferris Assessor's Map 124 Parcel 35 Lot 3 <br /> 24 Seconsett Point Road Registry of Deeds Title Reference: <br /> Mashpee,MA 02649 Book: 24.245 Page: 247 <br /> A Petition was filed on July 26,2010 by David M. and Ana Ferris for a Variance <br /> from Section 174-25.I(9) of the Zoning By-laws for permission to construct,maintain and <br /> license a dock on property located in an R-3 zoning district at 24 Seconsett Point Road <br /> (Map 124 Parcel 35)Mashpee,MA. The proposed construction requires a Special Permit <br /> from the Zoning Board.of Appeals. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 6, and August 13, <br /> 2010, a copy of which is attached hereto and made apart hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on August <br /> 25, 2010. The following members of the Board were present and acting throughout: <br /> Board Members Jonathan Furbush and William A. Blaisdell and Associate Board <br /> Members Peter R. Hinden and Ronald S. Bonvie. Board Member James Reiffarth <br /> stepped down. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. John Slavinsky of Cape &Islands Engineering represented the Petition and <br /> stated that proposed construction of the pier,ramp and float will consist of a total of 108 <br /> feet and will extend across a total of 80 feet of salt marsh. The Harbormaster,the <br /> Conservation Commission and the Department of Environmental Protection have <br /> approved the project. <br /> The Board expressed concern with construction of a dock on a vacant lot with no <br /> one to monitor its use and discussed conditioning the Decision in order to address that <br /> issue. <br /> GENERAL FINDINGS <br /> the subject property is located at 24 Seconsett Point Road and consists of 29,500 <br /> square feet of land. <br /> SECTION 174-25.I(9): <br /> Fixed and floating piers,wharves, docks,boardwalk,both seasonal and year- <br /> round, subject to the securing of all necessary permits from the town, state and federal <br />
