Field Assessor's Map 13 Parcel 45 <br /> 659 Main Street Registry of Deeds: <br /> Mashpee, MA 02649 Book 23957 Page 274 <br /> A Petition was filed on August 18, 2010 by Brett R. Field for a Variance from <br /> Section 174-32 of the Zoning By-laws to vary the fire protection access requirements to <br /> allow for an existing driveway on property located in an R-5 zoning district at 659 Main <br /> Street(Map 13 Parcel 45)Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee on September 3, and <br /> September 10, 2010, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> September 22, 2010. The following members of the Board were present and acting <br /> throughout: Board Members Robert G. Nelson, William A. Blaisdell, James Reiffarth and <br /> John M. Dorsey, and Associate Board Member Ronald S. Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Brett R. Field represented his Petition and said that he was seeking the <br /> Board's permission to vary the fire protection access for the existing driveway on the <br /> subject property. In response to Deputy Fire Chief Sheldon Hamblin's recommendations, <br /> Mr. Field said that the costs would be prohibitive - paving the driveway would exceed <br /> $30,000; installation of 1,000 feet of water line would cost more than the paving; <br /> installation of a sprinkler system would cost from $12,000 to $18,000. <br /> At its meeting on August 4, 2010, the Planning Board voted to grant Mr. Field a <br /> Special Permit with conditions. Inspection of the existing driveway by Consulting <br /> Engineer Charles L. Rowley revealed no drainage problems with the existing driveway. <br /> One of the conditions of the Planning Board's Special Permit requires the entire driveway <br /> to be widened to 20 feet before any residential construction is commenced on either Lots <br /> 1 A or 2A. <br /> Building Commissioner Richard Stevens said that the road is more than adequate <br /> for fire apparatus access. <br /> The Board agreed with Mr. Bonvie's statement that it is ludicrous and <br /> unreasonable to require the Petitioner to install 1,000 feet of water main. <br />
