(Owner of <br /> record: Mashpee Commons Limited Partnership). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on September 24, 2010, and October 1, 2010, a <br /> copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on October 13, <br /> 2010 and October 27, 2010. The following members of the Board were present and acting <br /> throughout: Board Members Robert G.Nelson, Jonathan Furbush,William A. Blaisdell and <br /> James Reiffarth and Associate Board Member Peter R. Hinden. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions <br /> of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> At the Public Hearings on October 13, 2010,Attorney Kevin M.Kirrane represented <br /> the Petitioner. Also in attendance were: <br /> Frank Almeida,V.P., Retail&Marketing—First Citizens Federal Credit Union. <br /> Peter J. Muise,President/CEO,Director—First Citizens Federal Credit Union. <br /> Engineer Michael J.Borselli; Falmouth Engineering—site layout and design. <br /> Architects Robert Morris and Chris Snell of New England Design—design of <br /> the structure and floor plans. <br /> First Citizens' Federal Credit Union is a Federally Chartered Institution which services <br /> the residents of Bristol,Plymouth,Norfolk,Barnstable,Dukes and Nantucket Counties with <br /> nine branch offices in Southeastern Massachusetts, including three branches on the Cape. <br /> Attorney Kirrane submitted photos of the property. The subject property is under agreement for <br /> purchase by the Petitioner and will be separately owned by the Credit Union upon the <br /> satisfaction of several contingencies, one of which is obtaining permitting from the ZBA. <br /> The proposal calls for construction of a branch facility which will consist of a 2,520- <br /> square foot, single-story building with a drive-up window and 13 parking spaces. Attorney <br /> Kirrane emphasized that the Credit Union use is a low-impact use that will not generate a large <br /> amount of traffic. The proposal does not pose a threat to public health or safety and will not <br /> have a detrimental impact on the area. There will not be an excessive demand on community <br /> facilities. <br />
