Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on September 24, 2010, and October 1, 2010, a copy <br /> of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on October 13, 2010 <br /> and October 27,2010. The following members of the Board were present and acting throughout: <br /> Board Members Robert G.Nelson, Jonathan Furbush,William A. Blaisdell and James Reiffarth <br /> and Associate Board Member Ronald S.Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A§10 and the Town of Mashpee Zoning By-laws. <br /> At the Public Hearings on October 13, 2010,Attorney Kevin M. Kirrane represented the <br /> Petitioner. First Citizens Federal Credit Union is a Federally Chartered Institution which services <br /> the residents of Bristol,Plymouth,Norfolk,Barnstable,Dukes and Nantucket Counties with nine <br /> branch offices in Southeastern Massachusetts, including three branches on the Cape. Also <br /> present at the hearings were: <br /> Frank Almeida, V.P.,Retail &Marketing—First Citizens Federal Credit Union. <br /> Peter J.Muise,President/CEO,Director—First Citizens Federal Credit Union. <br /> Engineer Michael J. Borselli,Falmouth Engineering—site layout and design. <br /> Architects Robert Morris and Chris Snell of New England Design—design of <br /> the structure and floor plans. <br /> Attorney Kirrane said that the parcel is under agreement for purchase by the Petitioner <br /> and will be separately owned by the Credit Union. The proposal calls for construction of a <br /> branch facility which will consist of a 2,520-square foot, single-story building with a drive-up <br /> window and 13 parking spaces on the subject property. <br /> The proposal has gone through stringent review by Mashpee Commons Limited <br /> Partnership and the Town's Design and Plan Review Committees. Because the subject property <br /> was part of a Massachusetts Environmental Policy Act(MEPA) filing by the Mashpee Commons <br /> Limited Partnership on an adjacent property, this proposal also required review by the regulatory <br /> committee of the Cape Cod Commission. On October 12, 2010,the Cape Cod Commission <br /> approved the amendment to the Development of Regional Impact(DRI). The Cape Cod <br />
