Goulet Map 114 Parcel 59 <br /> 207 Monomoscoy Road Registry of Deeds <br /> Mashpee,MA 02649 Book: 23019 Page: 56 <br /> A Petition was filed on October 5, 2010 by Stephen M. and Constance R. Goulet for <br /> Variances from Section 174-31 of the Zoning By-laws for permission to vary the front, side and <br /> lot coverage requirements in order to demolish a pre-existing,non-conforming structure and <br /> replace it with construction a single-family residence on property located in an R-3 zoning <br /> district at 207 Monomoscoy Road(Map 114 Parcel 59)Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on October 8, and October 15, 2010, a copy of <br /> which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on October 27, <br /> 2010. The following members of the Board were present and acting throughout: Board <br /> Members Robert G.Nelson,Jonathan Furbush;William A. Blaisdell,James Reiffarth and John <br /> M. Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions <br /> of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Attorney Kevin M.Kirrane represented the Petition. Mr. Stephen Goulet was also <br /> present along with the builder, Joao Junqueira of Capewide Enterprises. Attorney Kirrane <br /> submitted photos of the non-conforming,undersized property which abuts two streets, <br /> Monomoscoy Road and an undeveloped dirt road known as Overland Road. The existing <br /> single-story,ranch-style dwelling, which was built in the 1960's, does not conform to the front <br /> setback requirements or the side setback requirements. The existing lot coverage is 25%. <br /> The proposed construction will result in a three-bedroom dwelling that will conform to <br /> current building codes and will be an enhancement to the neighborhood. Lot coverage will be <br /> reduced by 4%. Building Commissioner Richard Stevens confirmed that the proposed stairway <br /> leading to the second level is allowed within the setback area because it is a means of egress. <br /> Parking will be relocated from Monomoscoy Road onto the property with access to the garage <br /> from Overland Road. No changes will be made to the existing septic system. This project will <br /> be similar to other raze-and-replace construction projects on Monomoscoy Road that have been <br /> approved by the Board. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS: <br /> The subject property is located at 207 Monomoscoy Road and consists of 4,650 square feet of <br /> land. <br />
