Gildea <br /> Clark,Balboni and Gildea <br /> 72 Main Street <br /> Bridgewater,Ma. 02324 <br /> Re; 12 Brookside Circle,Mashpee <br /> Request for Zoning Opinion <br /> Mark, <br /> I am.responding to your request for a Zoning Opinion regarding 12 Brookside Circle and the location of a building <br /> on this lot. <br /> In my opinion as long as the building meets the required setbacks for a Cluster Subdivision it will comply with <br /> zoning.The current setbacks for Cluster Subdivisions in the Town of Mashpee,are 30 feet from the front, 15 feet <br /> on the sides and 20 feet at the rear.These are the only setbacks that I would be able to enforce under the Town of <br /> Mashpee Zoning Bylaws. <br /> Your reference to Section 9.42(5) of the 1984 Town of Mashpee zoning Bylaw has to do with the initial layout <br /> and creation of a Cluster Subdivision, This section states that,"the minimum lot width at the required minimum <br /> setback line shall be not less than one hundred G 00)feet". In my opinion this entire subdivision was improperly <br /> endorsed and approved by both the Planning Board and the Zoning Board of Appeals as none of these lots meet <br /> that requirement.Furthermore your reference to the"Building Line"shown on the plans is unenforceable under <br /> Zoning.
