The measures proposed by the <br />applicant's representatives do not fully mitigate the effect of the additional runoff and <br />drainage issues. Finally, the proposed structure encroaches on the coastal bank and <br />existing pedestrian pathways, in violation of the Mashpee Bylaws S 174-33, causing an <br />adverse impact on the nearby waterways. For the reasons set forth herein, the Board <br />Finds that this project is substantially more detrimental to the area than the existing <br />dwelling. Accordingly, the Board finds that the applicant does not meet the standards set <br />forth in the Mashpee Bylaws §174-20 and y 174-24(C) and, therefore, the Board votes <br />unanimously to DENY the applicant's Special Permit Application with prejudice. <br />is <br />
