• 19. By order dated May 8, 2009, the Court remanded the <br />matter to the Board "to consider the prior evidence <br />presented to it and to make explicit, written findings <br />regarding their denial of the plaintiffs' <br />application." <br />20. on June 29, 2009, the Board filed with the Town Clerk <br />a "Confirmatory Decision for Special Permit Denied <br />with Prejudice" and "Confirmatory Petition for <br />Variance - Denied with Prejudice." A certified copy <br />of the Confirmatory Decision for Special Permit Denied <br />with Prejudice is attached hereto as Exhibit C, and a <br />• certified copy of the Confirmatory Petition for <br />Variance - Denied with Prejudice is attached hereto as <br />Exhibit D. <br />21. The proposed new dwelling would be consistent with the <br />character and size of the homes in the neighborhood, <br />which are situated on similarly undersized lots. <br />22. The proposed project includes installation of a Title <br />V sewage disposal system to replace the existing <br />cesspool. <br />23. The proposed project would improve drainage issues on <br />the property. <br />• 24. The proposed project includes sufficient parking. <br />
