Finally, the proposed structure encroaches on the coastal bank and <br />existing pedestrian pathways, in violation of the Mashpee Bylaws § 174-33, causing an <br />I adverse impact on the nearby waterways.. For the reasons set forth herein, the Board <br />Finds that this project is substantially more detrimental to the area than tine existing <br />dwelling. Accordingly, the Board finds that the applicant does not meet the standards set <br />forth in the Mashpee Bylaws §174-20 and §174-24(C) and, therefore; the Board votes <br />unanimously to DENY the applicant's Special Permit Application with prejudice. <br />0 <br />0 <br />b <br />
