MASHPEF. <br />TOkVH CLERK <br />Minutes — Wednesday, February 11, 2009 <br />09 MAR 26 A9 59 <br />The Mashpee Zoning Board of Appeals held a Public Hearing <br />on Wednesday, February 11, 2009 at the Mashpee Town <br />Hall. Board Members Robert Nelson, James Reiffarth, Jack <br />Dorsey, Jonathan Furbush, and William Blaisdell along with <br />alternate member Peter Hinden were present. <br />Robert Nelson opens the hearing at 7:00 pm. <br />There were no continuances to be read. <br />Revote: It was determined this lot was in a cluster subdivision <br />which changes the variance that the ZBA granted on January 28, <br />An 2009. <br />Kenneth Marsters, Trustee of Prime Prouerties Realtv Trust: Request a <br />Variance from Section 174-31 of the Zoning By-laws to seek relief from the <br />setback requirements on property located in an R-3 zoning district at 12 <br />Wintergreen Road (Map 103 Parcel 107) Mashpee, MA <br />Robert Nelson explained to the Board that the variance they granted at the <br />last hearing needs to be re -voted on. It was determined that the lot is in a <br />cluster subdivision and only requires a 30 foot setback instead of the 40 feet <br />that they voted on. Jack Dorsey makes a motion to change the 12 foot <br />variance on 12 Wintergreen Road to a 2 foot variance. Jonanthan Furbush <br />seconds the motion. All agree. So moved. The variance will now be 2 feet <br />and the decision will be written as such. <br />Stephen Marcus and Carol Auaustvniak: Requests a Special <br />• Permit from Sections 174-17, 174-20, 174-24C of the zoning by-laws <br />in order to raze and replace a pre-existing non -conforming structure <br />
