Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on February 20, 2009 and <br /> February 27, 2009 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 11, 2009 and continued until March 25, 2009 at which time the <br /> following members of the Zoning Board of Appeals were present and acting throughout: <br /> Robert Nelson, Jonathan Furbush, Peter Hinden and John Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represents the applicants Rick and <br /> Kara Proulx at this hearing. They have a 10 year old autistic child and after much <br /> looking around in the Mashpee area,they decided on this lot and house because they felt <br /> this could accommodate an inground swimming pool in order that their autistic son may <br /> enjoy and receive therapeutic benefit from a pool in their yard. They are seeking a <br /> variance to the front yard setback requirement in order to accommodate the pool and a <br /> variance to the required distance to the wetlands. Mr. Slavinsky asks the Board to <br /> withdraw his application for a Variance request for the distance to the wetlands. Changes <br /> in requests from Conservation has made this variance request no longer necessary. <br /> Motion is so made. <br />
