Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on March 6, 2009 and March 13, 2009, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on Wednesday, March 25, 2009, on the Petition at the Mashpee Town Hall on Wednesday, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, Peter Hinden and John Dorsey. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of Mashpee Zoning By-laws. Stephen Petrucci represents himself at this hearing. He is seeking a variance since he cannot meet the requirement of 50 feet to the coastal bank in order to build a porch and a deck. Conservation Commission has approved the matter. The Board discusses the plans with the applicant. Mr. Furbush mentions that there is only one driveway allowed on each property. After further review of the plans, Peter Hinden makes a motion to grant a 30 foot variance to the wetlands6g.e V D&s " 4eCO1 s the motion. All agree. So moved.
