Mashpee Zoning <br />• Board of Appeals Minutes <br />5 March 25, 2009 <br />He feels these condos are not in keeping with the character of the <br />neighborhood. He suggests the ZBA is pretending there is a hardship <br />when there truly is not. You cant create a hardship — this is simply a <br />technique for marketing. <br />John Dorsey asks if there would be any less of a hardship at 35 feet? <br />The applicant is currently before the planning board with 40 units. <br />Attorney McElhinney reiterates that they are here for a height <br />variance only — not to discuss the whole project. That is not the <br />responsibility of the ZBA at this time. <br />Nicolia Mastriocde of 27 Cranberry Ridne Road: He is <br />extremely opposed to the project and feels it seems much closer than <br />the 300 feet that they say it is. Would you want it in your back yard? <br />Robert Nelson tells the abutters to please stick to the <br />variance issue at hand and tells them its about astethics. <br />. Chris Tufts 7 Savanah Path : He asks about Mr. <br />Bornstein's buildings? Are they 35 and under as well? The <br />heights seem a lot higher than that. <br />Attorney McElihinney informs them that the pitch of the roof <br />has already been changed. <br />Scott Dravis — 83 Sampsons Mill Road: He is abutting the <br />other condos and is approximately 1,000 feet from them. <br />He tells the.board that the property was originally zoned for <br />13 single family homes not 48 condo units. There will be a <br />huge overload of traffic if these are built and will over power <br />the infrastructure of the town. He believes this is excessive <br />and they should stay with the height restrictions. <br />John Dorsey asks about a financial hardship. Mr. Nelson <br />• informs them that Town Counsel has informed him that <br />"financial" is not to be considered a hardship. <br />
