Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on April 3, 2009 and April <br /> 10, 2009 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was heard on April 22, 2009 on the Petition at the Mashpee <br /> Town Hall, at which time the following members of the Zoning Board of Appeals were <br /> present and acting throughout: Robert Nelson, Jonathan Furbush, James Reiffarth, <br /> William Blaisdell and Jack Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Mark Gildea represents the applicant at this hearing. He is seeking a <br /> Special Permit to have a 10 x 20 shed on applicants property. Mr. Gildea presents his <br /> case to the Board. He informs the Board that there are many other sheds in the <br /> neighborhood and presents the Board with a folder containing pictures of the various <br /> properties with sheds that abut his clients property. This lot is in the Popponesset <br /> Overlay District and was created before lot zoning was implemented. Mr. Nelson <br /> mentions that a 10' x 12' shed can be placed 5 feet off the lot line without any relief from <br /> the Board, however this shed is very large at 10 x 20.
