Mashpee Zoning <br /> Board of Appeals Joseph Dunne <br /> 3 SP-09-14 <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 and 17.4-20 of the Mashpee Zoning By-laws and Massachusetts <br /> General Laws Chapter 40A, Chapter 6, require a"Findings of Fact"that the razing, <br /> extension, alteration or removal shall not be substantially more detrimental to the <br /> neighborhood than the existing non-conforming use. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 167 Wading Place Road and contains <br /> 6,313 square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the proposal will INCREASE the non-conforming nature of the structure and <br /> the changes will result in a structure or use which is more detrimental to the <br /> neighborhood if they were to allow the shed to be built since the maximum lot <br /> coverage is 20%. The current lot coverage without the proposed shed is <br /> 23.6%. The proposal of the 10' x 20' shed would put the lot coverage at <br /> 26.8%. <br /> hl view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner did not meet the criteria necessary for the granting of a Special Permit.. 'Upon <br /> motion duly made and seconded, the Zoning Board of Appeals voted 3-2 to deny the <br /> motion. The Board referenced a plot plan from Cape & Islands Engineering, dated <br /> September 29, 2008. <br />
