Mashpee Zoning
Board of Appeals Minutes
l May 13, 2009
• Zoning Board of Appeals
Minutes — Wednesday, May 13, 2009
The Mashpee Zoning Board of Appeals held a Public Hearing
on Wednesday, May 13, 2009 at the Mashpee Town Hall.
Board Members, Robert Nelson, John Dorsey, Jonathan
Furbush, James Reiffarth and William Blaisdell were present.
Alternate member Peter Hinden was absent.
Robert Nelson opened the hearing at 7:00 p.m.
Jonathan Furbush reads the continuances. Mr. Nelson comments that the
continuances that continue to arise due to pending issues with conservation
is very frustrating to him and the Board and he feels it is unfair to any
interested parties to follow along with the hearings. He hopes to change the
by-law with regarding to filing with Conservation and the ZBA at the same
• time in order to alleviate the confusion this generally causes.
Informal Discussion: Tim Luff, Archi-Tect Associates addresses the Board
regarding an accessory apartment on Hoophole Road. He mentions that his
client would like to have a detached accessory apartment although the by-
law states that it needs to be attached. The parcel is 4 acres and he would
like to spend some more time preparing a detailed plan for the board to
review. Mr. Nelson mentions that yes, they do need to be attached and they
have adhered to that by-law pretty stringently. Due to the size of the parcel,
he would entertain some plans to see what they would like to build. Mr.
Luff thanks the Board for their time.
New Public Hearinas
Laurence and Laurie Gerber: Requests a Special Permit from Section 174-17
of the Zoning By-laws to alter a pre-existing non -conforming dwelling on
property located in an R-3 zoning district at 30 Ockway Bay Road (Map 100
Parcel 54) Mashpee, MA.
Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth, William
• Blaisdell and John Dorsey.
