• <br />Mashpee Zoning <br />Board of Appeals <br />1 <br />Executive Session Minutes <br />May 27, 2009 <br />Zoning Board of Appeals <br />Minutes — Wednesday, May 27, 2009 <br />The Mashpee Zoning Board of Appeals held a Public Hearing <br />on Wednesday, May 27, 2009 at the Mashpee Town Hall. <br />Board Members Robert Nelson, John Dorsey, Jonathan <br />Furbush, James Reiffarth and William Blaisdell were present. <br />Alternate member Peter Hinden was absent. <br />Robert Nelson opened the hearing at 7:00 p.m. <br />EXECUTIVE SESSION: <br />Robert Nelson makes a motion to go into Executive Session — he takes a roll call <br />vote for each Board member — Jonathan Furbush votes yes, James Reiffarth <br />• votes yes, William Blaisdell votes yes, John Dorsey votes yes. <br />Attorney Patrick Costello, Town Counsel, is present tonight to assist the ZBA in a <br />legal matter that is pending in court: <br />The Hubert Trust. Janet and Barry Krock: Request a Variance from Sections <br />174-28 and 174-31 of the Zoning By-laws in order to seek relief from lot <br />coverage (30%) in order to build a new dwelling on property located in a R-3 <br />zoning district at 4 Cross Street (Map 128 Parcel 15) Mashpee, MA. <br />The Hubert Trust. Janet and Barry Krock: Request a Special Permit from <br />Sections 174-17, 174-20 and 174-24c of the Zoning By-laws to raze and replace <br />the existing dwelling on property located in a R-3 zoning district at 4 Cross Street <br />(Map 128 Parcel 15) Mashpee, MA. <br />The ZBA denied both the Variance and the Special Permit request. The applicant <br />appealed the Board's decision and the Court remanded an&order for the Board <br />to set forth clearer specific findings as the Judge felt the Board's reasons for <br />their decisions were unclear. The Judge has ordered the Board to make explicit <br />written findings regarding their denial of the plaintiff's applications. <br />is <br />
