iown of Mashpee <br /> y�j S <br /> MASHPEE ZONING BOARD OF APPEALS 1G G�gat NEck acic� J�art1�, <br /> Ib'lasl�i,pee, Massachusetts 02649 <br /> Decision for a Special Permit <br /> "Findings of Fact" <br /> RE: Jeff and Susan Rutchik One Waterline Drive <br /> Map 120 Parcel 172 <br /> SP-09-30 <br /> A Petition was filed on August 18, 2009 for a Special Permit/Findings of Fact <br /> under Sections 174-17 of the Zoning By-laws for permission to raze and replace a pre- <br /> existing, non-conforming dwelling and rebuild a new dwelling on property located in an <br /> R-3 zoning district at One Waterline Drive (Map 120 Parcel 172) Maslipee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on August 21, 2009 and <br /> August 28, 2009 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was heard on Wednesday, September 9, 2009 on the Petition at <br /> the Mashpee Town Hall, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, James <br /> Reiffarth, William Blaisdell and Jolu1 Dorsey. <br /> Tim Luff, Archi-tect Associates represents the applicant at this hearing. They are <br /> applying for a Special Permit/Findings of Fact to tear this house down and rebuild a new <br /> dwelling. The existing dwelling encroaches on the buffer wetlands area and sits at 42 <br /> feet from the 50 foot setback requirement. The new dwelling will sit at 38 feet from the <br /> setback requirement, which is less detrimental to the resource area. Conservation <br /> Commission has approved this plan. They will be installing a new denitrification septic <br /> system which is a big improvement for the neighborhood. Mr. Nelson reminds the board <br /> they are only to be concerned with the distance to the wetlands and whether or not this <br /> will be substantially more detrimental to the neighborhood than what exists now.
