Mashpee Zoning
Board of Appeals Patricia Bell
2 SP-09-29
submitted as well as two letters of support from abutting neighbors. Attorney Kirrane
states that the is no consistency in the way the houses are set on the lots therefore this
would not make the project any more detrimental to the area. He states the is adequate
parking for the property, the dimensions they are proposing are acceptable and this
project will not make the home substantially more detrimental to the neighborhood. The
lot is large enough to handle the addition and still maintain the 20% lot coverage allowed
on the property. The Board reviews the plans and looks at the dimensions. After some
discussion, Jonathan Furbush moves to grant the Special Permit. William Blaisdell
seconds the motion. All agree.
SPECIAL PERMIT CRITERIA
Section 174-17 and 174-20 of the Mashpee Zoning By-laws and Massachusetts General
Laws Chapter 40A, Chapter 6, require a"Findings of Fact"that the razing, extension,
alteration or removal shall not be substantially more detrimental to the neighborhood than
the existing non-conforming use.
GENERAL FINDINGS
1. that the subject property is located at 45 Popponessett Island Road and
contains 16,500 square feet.
SPECIFIC FINDINGS
The Board determined that:
1. the proposal will not substantially be any more detrimental to the
neighborhood than the prior non-conforming structure and its use..
2. There is adequate parking on the property
3. The dimensional changes are amenable to the Building Commissioner.
In view of the foregoing, the Mashpee Zoning Board of Appeals found that the
Petitioner met the criteria necessary for the granting of a Special Permit for Findings of
Fact. Upon motion duly made and seconded, the Zoning Board of Appeals voted
unanimously on September 23, 2009 to grant a Special Permit/Findings of Fact to allow
for additional living space to be built to a preexisting non conforming structure. This is
conditioned on Plans from Cape &Islands Engineering, dated July 31, 2009,revised
