lown of hc <br />16 Grcot Neck Y coad ,,Vot-th, <br />Sarah and Robert Biemer <br />V-09-35 <br />Wash,pec, Nlassachusetts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A VARIANCE <br />14 Uncle Henry's Road <br />Map 117 Parcel 288-0-R <br />A Petition was filed on October 23, 2009 by Sarah and Robert Biemer of Milton, <br />Massachusetts for a Variance from 174-31 of the Zoning By-laws for setback relief in order to <br />expand an existing living space located at 14 Uncle Henrys Road (Map 117, Parcel 288-0-R) <br />Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws <br />Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br />general circulation in the Town of Mashpee, on November 27, 2009 and December 4, 2009, a <br />copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, <br />December 9, 2009, at which time the following members of the Board were present and acting <br />throughout: Robert Nelson, Jonathan Furbush, William Blaisdell and Peter Hinden. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br />Massachusetts General Law, Chapter 40A, Section 10 and the Town of Mashpee Zoning By- <br />laws. <br />Mr. and Mrs. Biemer represented their application. Mr. Biemer addressed the Board and <br />said that they have owned the subject home for 15 years. He said he is seeking setback relief to <br />allow for expansion of the home and improvement to the property. He said that the home is <br />within only a few feet of being centrally located on the lot. Adjacent abutting neighbors Mark <br />and Deborah Lavoie wrote a letter to the Board, which stated: "We respectfully ask that the <br />Board take note that we do not object to the Biemer's Petition and proposed plan". <br />The Board reviewed the plans. After discussing the proposal, the Board moved to grant a <br />Variance of 3.6 feet from the side setback requirements. <br />
