• Mashpee Zoning Minutes <br />Board of Appeals December 9, 2009 <br />Attorney Jack McElhinney and Chief Operating Officer David Wood represented <br />the applicant. Attorney McElhinney said that this vacant lot was the subject of a <br />previous Variance granted in 2005 by the Zoning Board of Appeals. This Variance <br />was subsequently granted an extension in 2007. He said that due to the lack of <br />prospective buyers in this economic situation, the applicant has decided to request <br />a new Variance rather than ask for an additional extension. Although the lot <br />exceeds the 40,000 square foot minimum, it contains 8,380 square feet of wetlands <br />and easements of 3,875 square feet for a total of 12,255 square feet. This reduces <br />the usable lot size from 48,674 square feet to 36,419 square feet, requiring a <br />Variance of 3,581 square feet from the land space requirements. <br />The Board members reviewed the plans and the previously granted Variance. Mr. <br />Furbush read the findings from Variance V-05-109. Mr. Nelson moved to grant a <br />Variance of 3,581 square feet from the land space requirements. Mr. Blaisdell <br />seconded the motion. All were in favor. This is conditioned upon compliance <br />with Vanasse Hangen Brustlin, Inc. of Watertown, Massachusetts plan entitled: <br />•"Lot 36 Shoestring Bay Estates, Willowbend Country Club — Mashpee, MA, Lot <br />Area Variance Plan, dated July 15, 2005, revised August 1, 2005 and August 22, <br />2005, Project Number 06528, Russell J. Bousquet, No. 35389, Land Surveyor, <br />Commonwealth of Massachusetts". <br />Steven and Lucinda Adams: Request a Special Permit from 174-17 of the Zoning <br />By-laws for a Finding of Fact on property located at 370-370A Monomoscoy Road <br />(Map 125, Parcel 16) Mashpee, MA. <br />Sitting: Robert Nelson, Jonathan Furbush, William Blaisdell and Peter Hinden. <br />Mr. Adams addressed the Board and said that he needed more time to conduct <br />research on the subject lot and the feasibility of his proposal. He asked for <br />Withdrawal Without Prejudice of the Petition for a Special Permit. Mr. Nelson <br />moved to grant the Request. Mr. Furbush seconded.
